Butterfield and Adams Deed for Dam, Factory and Mill

Deed between Abraham Butterfield and Solomon Adams of Wilton for the water rights for a dam, a cotton and sheepswool factory and mill.  Land in 1996 which abuts the stream where the factory was, is owned by Carol Weeks (Granddaughter of Frank and Dorothy Beedy) and Caroline Hamlin Mayo. The land is on the road between Rt 2 & 4 and McCrillis Corner and from Rt. 2 and 4 is on the left. The mill was built across on ledges on both sides of the stream. According to Robert Beedy, who grew up on his parents' farm, wood is visable even today. (2002)

Know all Men by these presents, That I Abraham Butterfield of Wilton, in the County of Kennebec and Commonwealth of Massachusetts, yeoman

 In consideration of one hundred Dollars paid by Solomon Adams of Farmington in the said County of Kennebec. Esqr. (the receipt whereof _____ do hereby acknowledge) do hereby give, grant, sell and convey unto the Said Solomon Adams, a certain tract of land Laying and being in Wilton aforesaid and being part of the lot Number one hundred and forty six as will appear on the plan of said Wilton bounding as follows (VIZ) beginning at a hemlock tree Standing on the South east Side of Wilsons Stream & in the East line of lot Number one hundred & forty six, thence up said Stream to the Mill Dam that is now erected acrost (sic.) Said stream that is attached to the said Butterfield's Mils (sic.), there up Said Stream or Pond about twenty rods to a stake & stones Standing by a hemlock Steele (?)(sic.) marked .A.  thene (sic.) North seventy five degrees East about twenty five rods to a Stake and stones Standing in the East line of Said lot, thence North fifteen degrees west on the lot line to the first mentioned Bounds containing about Six aceres (sic.) and further the said Adams his heirs and assigns is to have the privilage (sic.) of Erecting a Cotton and Sheeps wool Factory on the above described land below Said Mill dam as may appear most convaniant (sic.) and may Extend one third of the width of the Stream from low water mark into the water to be continued to him his heirs and assigns together with the Privelage (sic.) of drawing water from Said Mill dam for the purposs (sic.) of Driving the wheals (sic.) of Said factory in a flume or otherways as most convaniant (sic.) not to make unnecessary wast (sic.) of water, the water taken from Said pond not to Exceed such quantity as may be sufficiant (sic.) to constantly drive a Saw or Grist Mill wheele (sic.) and the privilage (sic.) of drawing water. Aforesaid Shall be continued to the said Adams his heirs and assigns free from any Expens (sic.) of Maintaining or Supporting the Dam acrost (sic.) Said Stream and in case the Said Butterfield his heirs or assigns Shall neglect to make use of any mill at or nere (sic.) the place now occupied then & in that case the said Adams or his assigns Shall have full liberty to Build maintain a dam in the place where the dam now is with liberty to flow the Same Pond that is now flowed by Said dam it is not to be understood that the Said Adams his heirs or assigns is to be at any xspens (sic.) in Repairing or Building any dam So long as Mills are continued by the Said Butterfield or his heirs, assigns or any person by or under him the Said East Privilage (sic.) mentioned in the above & to be continued to the Said Adams his heirs and assigns forever.

To HAVE and to HOLD the same to the Said Solomon Adams his heirs and assigns, to his and thair (sic.)use and benefit forever.

And I do covenant with the Said Adams his heirs and assigns, That I am lawfully seized in fee of the premises - That they are free of all incumberances - That I have good right to sell and convey the same to the Said Solomon Adams - And that I will warrant and defend the same to the Said Adams his heirs and assigns forever, against the unlawful claims and demands of any persons.

IN WITNESS THEREOF, I the said Abraham Butterfield and Ruth, wife of said Butterfield hath hereunto Set thair (sic.) hand and seal in token of thair (sic.) Releasing all thair (sic.) right of dowor (sic.) have hereunto set our hands, and seals, this fourteenth day of June in the year of our Lord one thousand eight hundred and ten.

Kennebec Co. June 15, 1810.   Then the above named Abraham Butterfield acknowledged this Instrument by him subscribed to be his free Act & Deed, before me, Thomas Johnson, Justice of Peace.
